J. Pedersen finds that the lower court properly denied the appellant's request for enforcement of the property division in a divorce decree, in which he specifically sought the conveyance of certain real property after the appellee allegedly failed to build a home there. Contrary to the appellant's argument on appeal, the build provision in the divorce decree is not ambiguous. Also, any conflict regarding "whether the decree conveys to appellee a fee simple absolute in the land or a fee simple determinable" is immaterial to the order denying his requested relief. Affirmed.

Per curiam, the Supreme Court of Ohio finds the lower court properly denied the wife's petition for a writ of prohibition to prevent the common pleas court from adjudicating claims brought by another owner of a multi-story building. The owner's claims regarding violations of an easement are entirely separate from the wife's divorce proceedings with her husband and the division of marital assets, which include part of the building. Therefore, the common pleas court has jurisdiction over the building owner's suit against the wife. Affirmed.

J. Rodriguez finds a lower court did not err in dividing a marital estate and denying a continuance in a divorce case. While the ex-wife argues she was “served too small a slice” of the estate, she has not shown how she was actually harmed by any alleged errors in valuation, nor how these alleged errors would have been an abuse of discretion by the court. Affirmed.
